These Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by PANDHESS ("the Seller") with individual consumers ("the Customer") wishing to purchase Products offered for sale on www.pandhess.com.
These Terms apply to sales made to Customers residing in the United States, subject to any mandatory federal or state consumer protection laws that may apply.
These Terms set out, in particular, the conditions relating to orders, payment, shipping, delivery, returns, refunds and warranties applicable to Products purchased by Customers.

www.pandhess.com offers chess sets and related products for sale online.

Customers should review this information before placing an order. The Customer is responsible for selecting the Product that meets their requirements.
PANDHESS makes reasonable efforts to represent Products as accurately as possible. However, slight variations in colour or appearance may occur due to screen settings, lighting conditions, materials or other display-related factors.

Product offers are valid while stocks are available.

By placing an order, the Customer acknowledges having read and accepted these Terms and Conditions of Sale.
The Customer represents that they have the legal capacity required to enter into the transaction.
The Customer selects the Products they wish to purchase on www.pandhess.com and adds them to their cart.
Before completing the order, the Customer has the opportunity to review the Products selected, quantities, shipping information and total price and to correct any errors.
The Customer is responsible for ensuring that all information provided when placing the order is complete and accurate.
An order becomes binding once payment has been successfully authorised and PANDHESS has sent the Customer an order confirmation by email.
The electronic records maintained by PANDHESS and its payment and e-commerce service providers may be used as evidence of transactions, subject to applicable law.
PANDHESS reserves the right, where permitted by applicable law, to cancel or refuse an order in the event of suspected fraud, payment issues, manifest pricing or technical errors, Product unavailability, or an order that is clearly abnormal or incompatible with normal retail purchasing.

PANDHESS will make reasonable efforts to accommodate the request, but an order cannot be guaranteed to be modified once it has entered processing, preparation or shipping.
If an approved modification results in a refund being due, the refund will be issued to the original payment method. Processing times may vary depending on the Customer's bank, card issuer or payment provider.
Customers may request cancellation as soon as possible through their Customer account at account.pandhess.com or by email at contact@pandhess.com.
Cancellation can only be guaranteed if the order has not yet entered processing, preparation or shipping.
If the order can no longer be cancelled, the Customer may request a return after receiving the Product in accordance with the PANDHESS Return & Refund Policy.
Products are sold at the prices displayed on www.pandhess.com at the time the Customer places the order.
Prices displayed for Customers in the United States are expressed in United States dollars (USD).
Before completing the order, the Customer is shown the total amount payable, including any applicable charges presented at checkout.
PANDHESS may offer promotional discounts from time to time. Any applicable conditions will be displayed with the relevant offer.
Prices may be changed at any time, but changes will not affect orders that have already been confirmed by PANDHESS.
Standard shipping to the United States is provided free of charge.

Payment is due in full when the order is placed.

PANDHESS currently ships Products exclusively to addresses within the United States.
Standard shipping is free of charge.
Orders are generally processed within :

Order processing takes place Monday to Friday, excluding weekends, public holidays and exceptional periods.
The daily order processing cut-off time is 3:00 PM (Paris time), Monday to Friday.

A tracking number is provided after shipment so that the Customer can follow the delivery of the order.
Delivery times are estimates and may occasionally be affected by circumstances beyond PANDHESS's reasonable control, including carrier disruptions, severe weather, customs or logistical delays, or periods of unusually high order volume.

PANDHESS will review the situation and provide an appropriate solution in accordance with applicable law.
If a Product is received damaged, defective or incorrect, the Customer should contact PANDHESS Customer Service as soon as reasonably possible.

Ownership of Products transfers to the Customer once full payment has been received, subject to applicable law.
Risk of loss or damage remains with PANDHESS until the Product is delivered to the Customer or another person designated by the Customer, except where applicable law provides otherwise.
PANDHESS provides Customers with a commercial return period of thirty (30) calendar days from the date the Product is received.
For orders containing multiple Products delivered separately, the 30-day return period begins on the date the last Product is received.

For a change-of-mind return, the Product must be returned complete, unused, undamaged and in a condition suitable for resale, together with all accessories and instructions supplied with it. Whenever possible, the Product should also be returned in its original packaging.
Return shipping costs are the responsibility of the Customer for change-of-mind returns, except where applicable law requires otherwise.
Before returning a Product, the Customer must contact PANDHESS to obtain the applicable return instructions and return address.
Returns sent without prior instructions or to an address other than the return address provided by PANDHESS may result in processing delays.
Where a Product is defective, damaged or incorrect, the Customer should contact contact@pandhess.com with the order number and, where possible, photographs or videos showing the issue.
Where a return is required because the Product is confirmed to be defective, damaged or incorrect, the applicable return shipping costs will be covered by PANDHESS.
Once a returned Product has been received and inspected, PANDHESS will notify the Customer regarding the status of the refund.
If the return is approved, the refund will be issued to the original payment method. The time required for the refunded amount to appear in the Customer's account may vary depending on the bank, card issuer or payment provider.
Original shipping charges, if any, are not refundable for change-of-mind returns, except where required by applicable law.
Certain Products may not be eligible for a change-of-mind return where permitted by applicable law, including Products made to the Customer's specifications or clearly personalised.

PANDHESS Products are intended for normal personal or household use unless otherwise stated on the applicable Product page.
In addition to any mandatory rights available under applicable law, PANDHESS provides a free two (2) year commercial warranty from the date of delivery.
This commercial warranty covers manufacturing defects, material defects and structural defects arising under normal use.
The PANDHESS commercial warranty does not cover normal wear and tear, misuse, improper care or maintenance, accidental damage, unauthorised modifications, or damage caused after delivery by improper handling or use.
These exclusions do not limit any mandatory rights the Customer may have under applicable law.
To make a warranty claim, the Customer should contact contact@pandhess.com and provide the order number and a description of the issue.
PANDHESS may request photographs or videos reasonably necessary to assess the claim.
If a return is required for a Product confirmed to be covered by the warranty, PANDHESS will provide the applicable instructions and cover the required return shipping costs.
Depending on the circumstances and subject to applicable law, an appropriate solution may include repair, replacement or refund.
The PANDHESS commercial warranty is provided in addition to, and does not replace or limit, any mandatory consumer rights available under applicable law.
PANDHESS collects and processes certain personal information necessary to operate the Website, process and fulfil orders, provide Customer Service, process payments and comply with applicable legal obligations.
Personal information may be shared with service providers and partners where reasonably necessary to provide these services, including payment, e-commerce, shipping, fulfilment, analytics and Customer Service providers, subject to applicable law.

To the extent permitted by applicable law, the parties acknowledge that changes in economic, commercial or logistical circumstances do not automatically entitle either party to modify the terms of an order that has already been confirmed.
Nothing in this Article limits any mandatory rights or remedies available to the Customer under applicable law.
PANDHESS will not be responsible for a failure or delay in performing an obligation where that failure or delay results from circumstances beyond its reasonable control, to the extent permitted by applicable law.
Such circumstances may include natural disasters, severe weather events, strikes, transportation or carrier disruptions, governmental actions, network or infrastructure failures, or other exceptional events beyond PANDHESS's reasonable control.
This Article does not exclude or limit any rights that cannot lawfully be excluded or limited.
These Terms and Conditions of Sale and transactions concluded under them are governed by French law.
However, this choice of law does not deprive Customers residing in the United States of any mandatory consumer protection rights available to them under applicable federal or state law.
These Terms are provided to Customers in English.
If a dispute arises in connection with an order, the Customer is encouraged to contact PANDHESS Customer Service first so that the parties may attempt to resolve the matter amicably.

If an amicable resolution cannot be reached, any dispute will be handled by the courts having jurisdiction under applicable law.

By placing an order through www.pandhess.com, the Customer acknowledges that they have reviewed the relevant Product information and applicable store policies and agree to these Terms and Conditions of Sale.
Placing an order creates an obligation to pay the total amount displayed at checkout.
